Welcome to Poshfit! These Terms and Conditions ("Terms") govern your access to and use of the Poshfit platform, mobile application, website, and related services (collectively, the "Services") operated by MonsterGrowth Consulting (OPC) Private Limited ("Poshfit," "we," "us," or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Definitions

For the purposes of these Terms:

  • "User," "you," or "your" refers to any individual or entity accessing or using the Services

  • "Designer" refers to verified tailors, fashion designers, or vendors who offer custom clothing services through our platform

  • "Consultation" refers to the at-home visit where measurements are taken and style preferences are discussed

  • "Measurement Profile" refers to the stored body measurements and preferences in your account

  • "Order" refers to a request for custom-made clothing placed through our platform

  • "Garment" refers to the custom-tailored clothing item produced based on your specifications

  • "Platform" refers to Poshfit's website, mobile application, and associated technology infrastructure

2. Acceptance of Terms

2.1 Agreement to Terms

By creating an account, placing an order, or otherwise using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy and any additional policies referenced herein.

2.2 Age Requirement

You must be at least 18 years old to use our Services. By using Poshfit, you represent and warrant that you are 18 years of age or older and have the legal capacity to enter into these Terms.

2.3 Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting updated Terms on our website and app

  • Updating the "Last Updated" date

  • Sending email notifications to registered users (for significant changes)

Your continued use of the Services after changes become effective constitutes acceptance of the modified Terms.

3. Description of Services

3.1 Poshfit Platform

Poshfit operates a concierge-style marketplace that connects customers with verified designers for custom-made clothing.

Our Services include:

  • At-home consultation and measurement services

  • Designer marketplace and catalog browsing

  • Secure measurement profile storage

  • Order placement and tracking

  • Payment processing through third-party providers

  • Doorstep delivery coordination

  • Fit guarantee and alteration services

  • Customer support and dispute resolution

3.2 Marketplace Model

Poshfit acts as an intermediary platform connecting you with independent Designers. While we verify and curate our Designer network, the actual garment production is performed by the Designer, not by Poshfit directly. We facilitate the transaction and provide quality oversight but are not the manufacturer of the clothing.

3.3 Service Availability

Our Services are currently available in select geographic areas. We will clearly indicate service availability during account registration and order placement. We reserve the right to expand or limit service areas at our discretion.

4. Account Registration and Security

4.1 Account Creation

To use most features of our Services, you must create an account by providing:

  • Full name

  • Valid email address

  • Phone number

  • Password

  • Service address (for consultation scheduling)

4.2 Account Accuracy

You agree to:

  • Provide accurate, current, and complete information

  • Maintain and promptly update your account information

  • Notify us immediately of any unauthorized access to your account

  • Be responsible for all activities that occur under your account

4.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials.

You agree to:

  • Use a strong, unique password

  • Not share your password with others

  • Log out after each session on shared devices

  • Accept responsibility for all activities under your account

4.4 Account Termination

You may delete your account at any time through account settings or by contacting customer support. We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent, abusive, or illegal activity.

5. Consultation and Measurement Services

5.1 Booking Consultations

To book an at-home consultation:

  1. Select your preferred date and time slot through the app

  2. Provide accurate address and contact information

  3. Pay the consultation fee (if applicable)

  4. Confirm appointment details

5.2 Consultation Fee

Launch Offer: ₹99 one-time consultation fee (regular price: ₹499)

The consultation fee covers:

  • Professional at-home visit

  • Precise measurement taking (16+ measurements)

  • Style consultation

  • Fabric viewing (when available)

  • Lifetime measurement profile storage

5.3 Consultation Process

During the consultation:

  • A verified Designer or measurement specialist will visit your home

  • They will take precise body measurements using professional techniques

  • You will discuss style preferences, occasion requirements, and design options

  • Fabric samples may be shown for selection and verification

  • Measurements will be uploaded to your Measurement Profile

  • The entire process typically takes 30-45 minutes

5.4 Rescheduling and Cancellation
  • Rescheduling: You may reschedule consultations up to 6 hours before the appointment at no additional charge

  • Customer Cancellation: Cancellations made less than 6 hours before the appointment may be subject to a cancellation fee

  • No-Show: If you are not available at the scheduled time and location, the consultation fee is non-refundable

  • Designer Cancellation: If the Designer cancels, you will receive a full refund or free rescheduling

5.5 Measurement Accuracy

You agree to:

  • Stand naturally and cooperate during measurement taking

  • Inform the specialist of any fit preferences or concerns

  • Review and confirm measurements before finalizing orders

  • Notify us immediately if you believe measurements are inaccurate

5.6 Measurement Profile Storage

Your Measurement Profile is stored securely and remains accessible for future orders. You may request deletion of your profile at any time, though this may affect our ability to fulfill future orders efficiently.

6. Ordering Custom Clothing

6.1 Placing Orders

To place an order:

  1. Browse Designer collections or work with a Designer on custom designs

  2. Select fabric, color, and design specifications

  3. Review your Measurement Profile or schedule a new consultation if needed

  4. Confirm order details, timeline, and pricing

  5. Complete payment through our secure payment gateway

  6. Receive order confirmation with expected delivery date

6.2 Order Confirmation

An order is confirmed only when:

  • You have completed payment

  • We send you an order confirmation email/notification

  • The Designer accepts the order

We reserve the right to refuse or cancel orders for reasons including but not limited to product availability, errors in pricing or product information, or suspected fraudulent activity.

6.3 Production Timeline
  • Standard Orders: 7-10 business days from order confirmation

  • Complex/Premium Orders: 10-14 business days (as specified at time of order)

  • Rush Orders: May be available for additional fees (subject to Designer availability)

Timelines are estimates and may vary based on design complexity, fabric availability, and other factors. We will notify you promptly of any delays.

6.4 Order Modifications
  • Before Production: Orders may be modified within 24 hours of confirmation at no additional charge

  • During Production: Modifications may not be possible or may incur additional charges

  • After Production: Order changes are not possible; alterations services may be available

6.5 Order Cancellation
  • Within 24 hours: Full refund minus payment processing fees

  • 24-48 hours: 50% refund if production has not begun

  • After 48 hours or production has begun: No refund available

7. Pricing and Payment

7.1 Pricing

All prices are displayed in Indian Rupees (₹) and include applicable taxes unless otherwise stated.

Prices may vary based on:

  • Fabric selection and quality

  • Design complexity

  • Customization requirements

  • Designer pricing

  • Urgency (rush orders)

7.2 Price Confirmation

The final price is confirmed before you complete payment. We reserve the right to correct pricing errors and will notify you if a correction affects your order.

7.3 Payment Methods

We accept payments through our secure payment gateway partner, Razorpay:

  • Credit/Debit Cards (Visa, Mastercard, Rupay, Amex)

  • UPI (Google Pay, PhonePe, Paytm, etc.)

  • Net Banking

  • Digital Wallets

7.4 Payment Processing

Payment Gateway: All payments are processed securely through Razorpay, a PCI-DSS Level 1 certified payment gateway.

Payment Entity: Payments are processed by MonsterGrowth Consulting (OPC) Private Limited on behalf of Poshfit.

7.5 Payment Security
  • Payment information is encrypted and transmitted directly to Razorpay

  • Poshfit does not store complete payment card details on our servers

  • Saved payment methods are securely tokenized by Razorpay

  • All transactions comply with RBI guidelines and Payment Card Industry standards

7.6 Payment Terms
  • Full payment is required at the time of order placement unless otherwise specified

  • Payment must be received before production begins

  • For orders above ₹10,000, we may offer installment payment options (subject to eligibility)

  • Failed payments will result in order cancellation

7.7 Taxes and Additional Charges
  • All applicable taxes (GST, etc.) are included in the displayed price

  • Additional charges may apply for rush delivery, special customizations, or premium services

  • You will be informed of all additional charges before payment confirmation

8. Delivery and Shipping

8.1 Delivery Method

Garments are delivered to your registered address via:

  • Doorstep delivery through our logistics partners

  • Hand delivery by the Designer (in select cases)

  • Pickup from Designer's studio (optional, if available)

8.2 Delivery Timeline

Standard delivery is within 7-10 business days from order confirmation.

You will receive:

  • Order confirmation with estimated delivery date

  • Production status updates

  • Dispatch notification with tracking information

  • Delivery confirmation

8.3 Delivery Address
  • Ensure your delivery address is accurate and complete

  • You may update the delivery address before production begins

  • Address changes after production may incur additional delivery charges

  • We deliver to all serviceable pin codes within our operating areas

8.4 Receiving Your Order
  • A signature or OTP confirmation may be required upon delivery

  • Inspect the package for any visible damage before accepting

  • Report any delivery issues within 24 hours

  • Ensure someone is available to receive the delivery at the provided address

8.5 Failed Delivery Attempts
  • If delivery fails due to incorrect address or unavailability, we will make 2 additional attempts

  • After 3 failed attempts, the order will be returned to the Designer

  • Re-delivery may incur additional charges

  • You must coordinate redelivery within 7 days or the order will be cancelled without refund

9. Fit Guarantee and Alterations

9.1 Perfect Fit Guarantee

Our Promise: We guarantee that your garment will fit perfectly when measurements are taken accurately and the garment is worn as intended.

9.2 Fit Issues

If your garment does not fit properly, you must:

  1. Report the fit issue within 7 days of delivery

  2. Provide photos showing the fit issue (if requested)

  3. Have the garment unworn (except for initial try-on) and with original tags

  4. Schedule a free alteration appointment

9.3 Alteration Services
  • Free Alterations: One round of complimentary alterations if fit issues are due to measurement or production errors

  • Alteration Process: The Designer or our alteration specialist will visit your home or you may visit their studio

  • Timeline: Alterations typically completed within 3-5 business days

  • Paid Alterations: Design changes or alterations due to body changes after measurement are subject to charges

9.4 Limitations

The fit guarantee does not apply if:

  • You provided inaccurate information during consultation

  • Your measurements have significantly changed since consultation (weight gain/loss, pregnancy, etc.)

  • The garment has been altered by a third party

  • The garment has been damaged, worn extensively, or washed improperly

  • Fit preferences were not communicated during consultation or ordering

10. Returns and Refunds

10.1 Custom-Made Nature

Due to the custom-made nature of our products, standard returns are not accepted.

All sales are final once production is completed, except in the following circumstances:

10.2 Eligible Returns

You may return a garment for a full refund if:

  • Material Defect: The garment has a manufacturing defect (torn seams, broken zippers, fabric flaws)

  • Wrong Item: You received a completely different garment than ordered

  • Severe Fit Issue: The garment is unwearable due to major measurement errors (not minor fit preferences)

  • Fabric Mismatch: The fabric significantly differs from what was shown/selected during consultation

10.3 Return Process

To initiate a return:

  1. Contact customer support within 7 days of delivery

  2. Provide order details and reason for return

  3. Submit photos showing the issue (if requested)

  4. Receive return authorization and instructions

  5. Package the garment in original condition with tags attached

  6. Ship or hand over to our collection agent

10.4 Return Conditions

Garments must be:

  • Returned within 7 days of delivery

  • Unworn (except for initial try-on)

  • Unaltered and undamaged

  • With all original tags and packaging

  • Clean and in resellable condition (when applicable)

10.5 Refund Processing
  • Inspection: Returned items are inspected within 3-5 business days

  • Approval: Refund is approved if return conditions are met

  • Processing: Refunds are processed to the original payment method within 7-10 business days

  • Deductions: Return shipping costs may be deducted if the return is not due to our error

10.6 Non-Refundable Items

The following are not eligible for refund:

  • Consultation fees (unless the consultation was not performed)

  • Garments returned after 7 days

  • Custom designs created to your specific specifications that meet the agreed-upon requirements

  • Garments that have been worn, altered, or damaged by the customer

  • Items purchased during special promotions marked as "non-refundable"

10.7 Exchanges

We do not offer direct exchanges. If you are unsatisfied with your garment and meet return eligibility criteria, you may return for a refund and place a new order.

11. Designer Relationships

11.1 Designer Verification

All Designers on our platform are:

  • Verified for identity and credentials

  • Evaluated for quality and craftsmanship

  • Required to maintain minimum quality standards

  • Subject to customer feedback and ratings

11.2 Designer Independence

Designers are independent service providers, not employees of Poshfit. The contractual relationship for garment production is between you and the Designer, with Poshfit facilitating the transaction.

11.3 Designer Ratings and Reviews
  • You may rate and review Designers after order completion

  • Reviews must be honest, factual, and based on your actual experience

  • We reserve the right to remove reviews that are abusive, defamatory, or violate our policies

  • Designers may respond to reviews through the platform

11.4 Designer Disputes

If you have a dispute with a Designer:

  1. First attempt to resolve directly through platform messaging

  2. If unresolved, escalate to Poshfit customer support

  3. Provide evidence and details of the issue

  4. Poshfit will mediate and determine appropriate resolution

12. Intellectual Property Rights

12.1 Poshfit Intellectual Property

All content on our platform, including but not limited to:

  • Poshfit name, logo, and branding

  • Website design and app interface

  • Text, graphics, images, and photographs

  • Software, code, and algorithms

  • Measurement methodologies and processes

...are owned by or licensed to Poshfit and protected by copyright, trademark, and other intellectual property laws.

12.2 Designer Intellectual Property

Designers retain ownership of their original designs, patterns, and creative work. By using our platform, Designers grant Poshfit a license to display their work for marketing and platform operation purposes.

12.3 User License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use our Services for personal, non-commercial purposes.

12.4 Restrictions

You may not:

  • Copy, modify, or create derivative works of our platform

  • Reverse engineer or attempt to extract source code

  • Use our branding, logos, or trademarks without permission

  • Scrape, harvest, or collect user data from our platform

  • Use our Services for any commercial purpose without authorization

12.5 User Content

By submitting content (reviews, photos, feedback, etc.) to our platform, you grant Poshfit a worldwide, royalty-free, perpetual license to use, display, and distribute such content for marketing and operational purposes.

13. User Conduct and Prohibited Activities

13.1 Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms.

13.2 Prohibited Activities

You may not:

  • Violate any applicable laws or regulations

  • Provide false or misleading information

  • Impersonate another person or entity

  • Engage in fraudulent activities or payment disputes in bad faith

  • Harass, abuse, or threaten Designers or Poshfit staff

  • Interfere with or disrupt the Services or servers

  • Attempt to gain unauthorized access to our systems

  • Use automated tools (bots, scrapers) without permission

  • Upload viruses, malware, or malicious code

  • Spam or send unsolicited communications

  • Violate intellectual property rights

  • Engage in any activity that damages our reputation or business

13.3 Consequences of Violation

Violation of these Terms may result in:

  • Immediate suspension or termination of your account

  • Cancellation of pending orders without refund

  • Legal action for damages

  • Reporting to law enforcement authorities

14. Disclaimers and Limitations of Liability

14.1 Service "As Is"

Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Merchantability

  • Fitness for a particular purpose

  • Non-infringement

  • Uninterrupted or error-free operation

14.2 No Guarantee of Results

While we strive for excellence, we cannot guarantee:

  • That garments will meet all subjective expectations

  • Specific aesthetic outcomes beyond agreed specifications

  • Exact color matching due to variations in fabric batches and display settings

  • Perfect fit for all body types and postures (though we provide a fit guarantee for reasonable expectations)

14.3 Third-Party Services

We are not responsible for:

  • Actions or omissions of Designers (though we will assist in dispute resolution)

  • Third-party payment processors (Razorpay) beyond our reasonable control

  • Logistics and delivery partners

  • Third-party websites or services linked from our platform

14.4 Limitation of Liability

IMPORTANT: To the maximum extent permitted by law, Poshfit shall not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages

  • Loss of profits, revenue, data, or business opportunities

  • Damages exceeding the amount you paid for the specific order in question

This limitation applies whether the claim is based on contract, tort, strict liability, or any other legal theory, even if we have been advised of the possibility of such damages.

14.5 Exceptions

Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence

  • Fraud or fraudulent misrepresentation

  • Any liability that cannot be excluded or limited under applicable law

15. Indemnification

You agree to indemnify, defend, and hold harmless Poshfit, its affiliates, officers, directors, employees, agents, and licensors from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your use of the Services

  • Your violation of these Terms

  • Your violation of any rights of another party

  • Any content you submit or share through our platform

  • Your violation of any applicable laws or regulations

16. Dispute Resolution

16.1 Informal Resolution

Before initiating formal proceedings, you agree to first contact our customer support team to attempt to resolve the dispute informally. We will make reasonable efforts to resolve the matter amicably.

16.2 Arbitration

Any dispute that cannot be resolved informally shall be settled by binding arbitration in accordance with the Arbitration and Conciliation Act, 1996.

  • Arbitration Seat: Kolkata, India

  • Number of Arbitrators: One (1) arbitrator mutually agreed upon, or appointed according to law

  • Language: English

  • Costs: Each party bears its own costs unless the arbitrator determines otherwise

16.3 Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis only, and not as a class action, consolidated action, or representative action.

16.4 Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Subject to the arbitration provisions above, the courts of Kolkata, West Bengal shall have exclusive jurisdiction over any disputes.

17. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our Privacy Policy.

  • We collect personal information, measurement data, and payment information as described in our Privacy Policy

  • We use industry-standard security measures to protect your data

  • We share information with Designers and service providers as necessary to fulfill orders

  • You have rights to access, correct, and delete your data (subject to legal requirements)

18. Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to:

  • Acts of God (earthquakes, floods, storms)

  • War, terrorism, civil unrest

  • Government actions, laws, or regulations

  • Pandemics or public health emergencies

  • Labor strikes or disputes

  • Utility failures or telecommunications outages

  • Supplier or logistics disruptions

In such events, we will make reasonable efforts to minimize impact and notify affected users promptly.

19. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms referenced herein, constitute the entire agreement between you and Poshfit regarding the use of our Services and supersede all prior agreements and understandings.

20. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

21. Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of Poshfit.

22. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets, or by operation of law.
